Raymo853 CRBC: Fry Plea Agreement - 2007/02/13 10:49 A major topic of yesterday's CRBC Ex Council meeting was about the court case stemming from the death of Bohdan Kulakowski. CRBC is planning a few activities and efforts regarding this situation. Today's Daily Collegian has an article about what the plans are:

Demon of the Fall Re:CRBC: Fry Plea Agreement - 2007/02/13 13:21 I was shocked when I read about this plea bargain and that there would only be house arrest. I was also blown away when I read how bad the driver's eyesight was. How can you get behind the wheel when your eyes are 20/200 and 3/200? That means that in one eye he could only see at 3 feet what people with 20/20 see at 200 feet. The doctor said he could only see raised fingers when they were held right in front of his face. This condition was discovered in the eighties. How could he drive for that long with eyesight that bad? It is very irresponsible. A cyclist commuting home from work was killed, and the driver should receive a stronger punishment than a max of 12 months house arrest.

hodog Re:CRBC: Fry Plea Agreement - 2007/02/13 13:39 The van driver is old and not in that great of health so the DA wanted to avoid jail time. He is also unable to perform public service. On the other hand the crime is vehicle manslaughter which is a felony. Plus would this 'punishment' be a deterrent to anyone? I think the streets just got a little less safe.

kevinb Re:CRBC: Fry Plea Agreement - 2007/02/13 13:52 unfortunately its not just here, I saw a news story recently about a girl who killed a cyclist while not paying attention to the road because she was trying to down load music/ringtones on her phone. she got even less than this proposed plea agreement.

Raymo853 Re:CRBC: Fry Plea Agreement - 2007/02/13 14:29 Unlike some, I do not see this as proof pedistrians and cyclist are protected less than drivers. There are many cases where foolish, inattentive but sober drivers kill other drivers and never get charged with anything. Twice in the last year people in their cars have been crushed by a dozing tractor trailer driver, once on (summer somwetime) I80 and just recently (~Jan 25th) on I99, and neither case has resulted in charges.

I do not understand why if you do foolish things that result in the death of another you are given a free pass if you were driving a vehicle.

Fry isn't that old. He is younger than the cyclist he killed. I think Fry is mid to late fifties. He was/is (?) still working, that is why he was driving. He was coming home from work just like Dr. Kulakowski. The excuse of being too old and not in good health to serve prison time or too blind to perform community service does not fly in this case.

frank Re:CRBC: Fry Plea Agreement - 2007/02/13 15:53 He was charged with Vehicular Homicide, not manslaughter, expressly because he had been told not to drive. He had applied for disability because of his eyesight on numerous occasions.
The absolutely amazing thing is that he has yet to lose his license when he has appeared in court, even though it has been repeatedly pointed out that he is unfit to hold a license.
He also had a traffic accident a month after killing DR Kulakowski, so he obviously doesn't see anything wrong with his actions.
How much do you think the community would freak out if the kid who killed the guy crossing Atherton was offered this plea deal? In both cases the driver was impaired, but Fry had known about his impairment for 20 years and yet he continued to get behind the wheel.
